Exemption from Soka-Bau

Employers posting employees in the construction industry to Germany are required to register at the Soka-Bau Construction Fund and pay contributions to the aforementioned cash register.

Exemption from the obligation to participate in the Soka-Bau Construction Fund is possible if the enterprise pays contributions for posted employees in the home country (comparable holiday pay fund in the home country). Then the employer can submit to SOKA-BAU a certificate confirming the payment of contributions (in home country Construction fund) for these employees during their employment in Germany.

In such cases, SOKA-BAU may exempt the enterprise from participating in the German Soka-Bau proceeding. Double payment of holiday conrtubutions is therefore excluded.

There are currently agreements on mutual recognition of holiday contributions with several European Union countries and the Federal Republic of Germany.

The second way to be exempt from participation in Soka-Bau is by fulfilling the conditions to get exemption and submitting a formal application with complete documentation justifying the grounds for the exemption.
