All companies working in the construction sector or public works are required to be part of the local Construction Holiday Fund.
From the moment when the company hires employees regardless of their qualifications, duration and nature of the contract, except for trainees, the company is obliged to register its employees in the Construction Holiday Fund and pay contributions for each employee.
Companies based outside of France, posting their workers on its territory must meet the same conditions of affiliation.
Foreign companies belonging to the European Union may be exempted from this obligation, provided that they prove that their employees enjoy the right to paid leave during the secondment under conditions which comply with the conditions provided for by French legislation.
In the event of labour inspection, you will be obliged to provide a certificate of registration or an exemption from the obligation to belong to the relevant Construction Holiday Fund.
Depending on the country, the rules to get the exemption are not the same. Indeed, the Union of Construction Holiday Fund (UCF CIBTP) has signed an agreement exempting becoming a members in Construction Holiday Fund for three European Union member states: Germany, Italy and Austria. The procedures for the secondment of construction companies in these countries are established by this agreement.
