The companies wishing to carry out construction works in the Grand Duchy of Luxembourg are obliged to obtain the permission in order to perform services in Luxembourg (Certificat). This requirement also applies to foreign companies carrying out occasional and cross-border works in Luxembourg.
Who is obliged to obtain permission?
Any construction company that wants to carry out construction works in Luxembourg is required to inform the appropriate administration about services that are to be performed in the territory of Grand Duchy of Luxembourg.
As a result of the notification, the construction company receives a special certificate authorizing the execution of works (Certificat de Déclaration Préalable).
Please note that the certificate does not give you an unlimited right to perform services in Luxembourg. It authorizes only for temporary and occasional services. It is also important that the certificate must be obtained before commencing any activity in Luxembourg and that the scope of activity is strictly limited to the sector indicated in this document.
To obtain the certificate, you must prove the experience in the works that the company intends to perform in Luxembourg.
This experience should be confirmed by an appropriate attestation from national office. The period of experience in specific works and other conditions are also important.
If the conditions required by the Luxembourg office are not met, it will not be possible to issue the certificate and the foreign company will be forced to suspend works in Luxembourg.
